Terms of Service

1. General and Parties

These Terms of Service (”Terms”) constitute a legally binding agreement between you (”User”, ”you”) and Arctic Virtual Trade Oy. The Terms govern the use of the CSKejsaren service.

The service is provided by:

CSKejsaren purchases Counter-Strike 2 virtual items from users in exchange for money. CSKejsaren is not owned, operated or endorsed by Valve Corporation or any of its affiliates, and has no other connection to Valve Corporation.

2. Definitions

Service means the cskejsaren.se website, its sales chat, the Automated Sale and other services and features provided by CSKejsaren.

Automated Sale means the feature of the Service where a sale is completed in the Service as self-service, without separate interaction in the sales chat.

Steam Sign-In means signing in to the Service with a Steam account through Steam's authentication feature (OpenID). Through Steam Sign-In, CSKejsaren does not obtain your Steam password or access to your Steam account.

Skin or Virtual Item means a virtual item or licence related to the game Counter-Strike 2 that is linked to the User's Steam account.

Standard Payment means a sale method where the purchase price is paid to the User after the Trade Protection period has ended.

Advance Payment means a sale method offered by CSKejsaren where the purchase price is paid to the User in full or in part before the end of the Trade Protection period.

Trade Protection means a feature of the Steam platform during which (approximately 7–8 days from the acceptance of the trade) a party to a Steam trade can reverse a completed trade.

Strong Authentication means verification of identity using a strong electronic identification method (for example BankID or bank credentials) through the identification service provider Signicat.

3. Acceptance and Amendment of the Terms

By using the Service you accept these Terms and confirm that you have read our Privacy Policy. If you do not accept the Terms, you are not entitled to use the Service.

We may update these Terms. The version currently in force is available in the Service, and the date of the most recent change is indicated at the beginning of the Terms under ”Last updated”. We will announce material changes prominently in the Service. By continuing to use the Service after changes take effect, you accept the updated Terms. Each individual transaction is governed by the Terms in force at the time the transaction was made.

4. Right to Use the Service and Age Limits

Use of the Service requires that you are at least 13 years old.

Adults (18 years and older): You may use all features of the Service, including Advance Payment.

Minors (13–17 years old): You may sell Skins only with Standard Payment and only with the consent of your legal guardian. Please ask your guardian to read these Terms and accept them on your behalf before using the Service. CSKejsaren has the right to request evidence of the guardian's consent and the right to refuse a transaction if such evidence is not provided. Advance Payment is not available to minors.

These age limits apply to transactions made both in the sales chat and in the Automated Sale. In the Automated Sale, you confirm your age and, where applicable, your guardian's consent when accepting these Terms. When Advance Payment is used, age is verified as part of Strong Authentication. CSKejsaren has the right to request further evidence of age or guardian consent and to suspend a transaction until such evidence has been provided.

By using the Service you represent and warrant that:

• you have legal capacity to enter into contracts or you have your guardian's consent to use the Service;
• you own the Virtual Items you sell or otherwise have a lawful right to dispose of them;
• you do not use the Service for unlawful purposes or on behalf of a third party without appropriate authorisation;
• you are not listed on international sanctions lists (EU, UN, OFAC or equivalent) and do not act on behalf of a person listed on such lists.

5. Transaction Process and Formation of the Agreement

You can sell Skins either in the Service's sales chat or through the Automated Sale. Both sale methods are available with both Standard Payment and Advance Payment, and the formation of the agreement and the Trade Protection commitment are the same in both.

Sale in the sales chat

1. You initiate the sale in the Service's chat and provide the requested information (including the items to be sold, your name, address, email address and phone number, Steam trade link and payment details).
2. Our customer service agent assesses the items and makes you an offer.

Sale through the Automated Sale

1. You sign in to the Service using Steam Sign-In. Upon sign-in we receive your Steam identifier (SteamID) and the publicly available profile and item information of your Steam account.
2. You select the items to be sold, after which the Service presents you with an offer. You provide the requested information (including your name, address, email address and phone number, and payment details) and, when using Advance Payment, complete Strong Authentication.

In both sale methods

1. CSKejsaren may withdraw the offer at any time before it has been accepted.
2. When you accept the offer, you undertake to send the items to CSKejsaren. A binding sale is formed when the items have been transferred to CSKejsaren on Steam and the purchase price has been paid to you. You undertake not to reverse the completed Steam trade using Steam's Trade Protection feature; a breach of this undertaking is handled in accordance with Section 7.
3. You send the items to the Steam account designated by CSKejsaren in accordance with our instructions. You are responsible for ensuring that you send the items to the correct account designated by CSKejsaren.
4. CSKejsaren pays the purchase price in accordance with the payment method you have chosen (Advance Payment or Standard Payment).

Accepting the offer and signing the Terms does not obligate CSKejsaren to accept the Steam trade or to complete the transaction. CSKejsaren may decline to accept the trade and to complete the transaction, for example due to a technical impediment, an error or a suspicion of misuse. In such a case no binding sale is formed, no obligations based on it arise for either party, and any items already transferred will be returned to you without delay.

Ownership of the Virtual Items transfers to CSKejsaren when the Steam trade has been completed, to the extent that ownership and usage rights are transferable under the terms of Steam and Valve Corporation.

6. Prices and Payments

The price we offer is based on CSKejsaren's assessment of the item's market price at the time of the offer. The Standard Payment price may be higher than the Advance Payment price.

Payments are made in SEK or EUR by bank transfer or Swish to the bank account or number you have provided. In Swish transactions, the purchase is carried out by our partner Jacob Pay Ab, which purchases the items in CSKejsaren's name and on its behalf; in these transactions the payment may be made to you by Jacob Pay Ab. Your contractual counterparty is in all cases Arctic Virtual Trade Oy, and these Terms apply to the transaction in full. By accepting these Terms you acknowledge that the information necessary for completing the transaction and the payment may be disclosed to Jacob Pay Ab as described in our Privacy Policy. You are responsible for the correctness of the payment details you provide; we are not liable for damage caused by incorrect payment details. Nor are we liable for delays caused by banks, payment intermediaries or other circumstances beyond our control.

Use of the Service is free of charge for the User, and no separate fees are deducted from the purchase price unless expressly agreed otherwise.

You are solely responsible for any tax consequences of your sales in accordance with the taxation applicable to you.

7. Advance Payment and Trade Protection Terms

Receiving an Advance Payment requires that:

1. you are at least 18 years old;
2. you have completed Strong Authentication in the Service;
3. you have provided the required information (including your name, current address, email address and payment details);
4. you have accepted these Terms and read the Privacy Policy;
5. you have sent the Steam trade to CSKejsaren; and
6. you have committed not to reverse the Steam trade during the Trade Protection period.

The commitment not to reverse the trade is an essential term of the Advance Payment. The Advance Payment is based on CSKejsaren paying the purchase price in reliance on the permanence of the trade.

If you reverse the trade during the Trade Protection period or otherwise breach this Section, CSKejsaren has the right to:

1. demand the immediate repayment of the purchase price paid;
2. charge a cancellation fee of 20% of the purchase price, however no less than EUR 50, together with the reasonable costs of recovering the receivable;
3. suspend or block your use of the Service;
4. record information concerning the breach in the customer register as described in the Privacy Policy; and
5. take collection and legal action and file a criminal complaint if the conduct meets the elements of an offence punishable under the Finnish Criminal Code (39/1889), such as fraud (Chapter 36, Section 1).

In the event of a reversal, we will send an invoice for the repayment of the purchase price and the cancellation fee by email and by post. The payment term of the invoice is 14 days. If the invoice is not paid by the due date, we will send a payment reminder, and the unpaid receivable will be transferred to Svea, Intrum or other debt collection office for collection.

CSKejsaren has the right to assign the receivable to its collection partner Svea or Intrum and to disclose the information necessary for carrying out the collection within the limits permitted by law.

8. Identification and Prevention of Misuse

CSKejsaren has the right to request verification of your identity and other information in order to prevent and investigate fraud and other misuse, and to comply with any legislation that may apply to it.

If you do not provide the requested information, CSKejsaren may refuse or suspend the transaction.

We cooperate with the authorities in order to fulfil our legal obligations and may disclose to the authorities information they request pursuant to law.

9. Binding Nature of the Sale, Cancellations and CSKejsaren's Right to Cancel

A sale formed and completed in accordance with Section 5 is binding on both parties and final. Because CSKejsaren purchases the Virtual Items from you, the statutory right of withdrawal for distance selling under consumer protection legislation does not apply to the transaction.

CSKejsaren nevertheless has the right to cancel an individual transaction and return the items it has received to you (or, if return is not possible, compensate their value) if:

• an obvious pricing, processing or system error has occurred in the offer or in the processing of the transaction;
• there is a justified reason to suspect fraud, the sale of stolen or unlawfully held items, or other misuse;
• completing the transaction would violate law or an order of an authority; or
• you do not meet the requirements of these Terms (for example the age limits or identification requirements).

10. Prohibited Use

When using the Service, you agree that you will not:

1. misrepresent yourself as a partner or representative of CSKejsaren;
2. use the Service in a manner that violates Finnish law or other legislation applicable to you;
3. damage, disrupt or attempt to damage the Service or its information security;
4. copy the content, layout or source code of the Service without our permission;
5. use parts of the Service that are not intended for use by Users, or seek unauthorised access to the administrative or security functions of the Service;
6. impersonate another person or use another person's information without their authorisation;
7. mislead or attempt to defraud CSKejsaren or other Users; or
8. circumvent or disable the security features of the Service.

A breach of the Terms may lead to the restriction or blocking of your use of the Service without prior notice, and where necessary to legal action.

11. Intellectual Property Rights

The Service and its content, including texts, images, logos, layout and software code, are the property of CSKejsaren or its licensors and are protected by intellectual property rights. The content may not be copied or used commercially without our written permission.

Counter-Strike, CS2, Steam and the related trademarks and game content are the property of Valve Corporation.

12. Limitation of Liability

The Service is provided ”as is”. We do not warrant the uninterrupted or error-free operation of the Service, nor the accuracy or timeliness of the information presented in the Service (such as price estimates).

We are not liable for indirect damage, such as loss of profit or changes in the value of Virtual Items. Nor are we liable for damage caused by the operation, errors or outages of the Steam platform, banks or other third parties.

The Service may contain links to third-party websites. We are not responsible for their content or services.

Nothing in these Terms limits liability that cannot be limited under mandatory legislation, including liability for damage caused intentionally or by gross negligence, nor the rights of a consumer under mandatory consumer protection legislation.

13. Marketing Giveaways

Giveaways and competitions organised by us are governed by separate rules published in connection with each giveaway. Giveaways are free of charge, and participation does not require a purchase.

14. Governing Law and Dispute Resolution

These Terms and the use of the Service are governed by the laws of Finland. This choice of law does not deprive you, as a consumer, of the protection afforded to you by mandatory provisions of the law of the country in which you have your habitual residence — for consumers residing in Sweden, mandatory Swedish consumer protection law.

We aim to resolve any disagreements primarily through negotiation. Please contact our customer service at [email protected].

If a disagreement cannot be resolved, the matter will be settled in a competent court in Finland. As a consumer, you always also have the right to bring proceedings before the courts of your place of domicile.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in force.
